A leading international construction company specialized in infrastructure is seeking an experienced Contracts Advisor for a new 6 Km. bridge, prefabricated prestressed and reinforced concrete, including railway and tunneling sections.
Reports to: Commercial Manager
Subordinate: 1 Contracts Engineer
Purpose of the position
The contracts engineer shall enruse the management of contracts and claims towards client and subcontractors.
Duties and responsibilities
to manage the setup of commercial systems and documentation for new managed service contracts from the point of the tender award up to closure of the project
undertake all contract evaluations and governance aspects, including review, validation, variation of contract, and sign-off of annual renewals
to liaise with managers in the construction and implementation of appropriate contract documentation to support commercial proposals to customers on behalf of the company
to manage contract issues and adverse financial trends escalated from the managed services Administration team, investigate variance, and provide solutions for closing gaps to the satisfaction of all parties
to identify any deviations from agreed commercial policies, contracts and guidelines
capable of drafting standard contract documents such as non-disclosure agreements, variation of contracts, change control documents, framework schedules, etc.
capable of negotiating with third parties and customers on any contractual document to get to an agreed position that meets the commercial, compliance, and business needs
to provide contract management expertise and to assist in the development of sound commercial processes that meet corporate/business areas goals and metrics
to use contract and finance structures in compliance with business objectives
7+ years' experience in the management of FIDIC Contracts in the construction of infrastructure projects
full understanding of construction processes of infrastructures like bridges, railway tracks and tunnels, etc.
excellent English knowledge, both oral and written
experience in key legal risk areas such as but not limited to contractual liability, insurance requirements, defective performance, and warranty obligations
understanding of key commercial risks and ability to lead risk review process and assessments
